Terms and privacy

By using SunSpotters you agree to these terms. Please read them first. If you do not agree, please do not use the app. These terms form a binding agreement between you and SunSpotters.

What is SunSpotters?

SunSpotters lets you share and enjoy the world's most beautiful sunsets and sunrises. It is run by SunSpotters, based in the Netherlands.

The app is for personal use, not for business use; for example, photographers, travellers, teachers and anyone who loves golden hour.

Your account

Some parts of the app need an account. You are in charge of keeping your sign-in details safe. Please tell us straight away if you think someone else has used your account.

You must be at least sixteen years old to have an account. If you are younger than sixteen you cannot use SunSpotters.

We may pause or close your account if you break these terms, or if the law asks us to.

Fair use

You may only use SunSpotters for lawful things. In short, please do not:

• use the app to hurt, upset or mislead other people;
• copy or take data from the app in bulk without our written go-ahead;
• try to reach parts of the app you are not meant to see;
• upload anything against the law, hurtful, or that belongs to someone else;
• use the app in a way that could harm or slow it down;
• pretend to be another person or company.

We may remove content or block someone without warning if we believe these rules have been broken.

Your content

If you upload photos, notes or other things to SunSpotters, they still belong to you. By uploading them you give us permission to use, adjust, share and work with them, along with the details attached to them, in order to run the app and to make it better in the future.

Please only upload things that belong to you or that you have the right to share.

Our content

The SunSpotters name, logo, look and our own words belong to us. Please do not copy or share them without asking us first.

What we promise, and what we do not

SunSpotters is offered as it is. We aim for it to be right and up to date, but we cannot promise this. Do not rely on SunSpotters for any decision where safety matters.

We are not responsible for loss or harm from using the app, except where the law says we must be. If you are a shopper in the EU, this clause does not take away the rights the law gives you.

EU shopper rights: nothing in these terms takes away the rights the EU gives you, which include the right to a fix if a digital service does not work as it should.

Changes to these terms

We may update these terms from time to time. If we make a big change we will let you know in the app or by email at least thirty days before it starts. If you keep using the app after that date, you agree to the new terms.

The law that applies

These terms are governed by Dutch law. If you are a shopper in the EU, you also keep any rights that the law of your own country gives you. Any dispute will be handled by the courts of the Netherlands, or by a simpler dispute service if you would rather.

You can also use the EU online dispute service at ec.europa.eu/consumers/odr.

We take your privacy seriously. This page explains what we hold about you, why we hold it and how we look after it. SunSpotters is in charge of your details, which means we decide how they are used. The reasons we are allowed to use them are set out in EU law.

What we hold

We only hold what the app needs to work. This is what we may keep about you:

Sharing where you are is up to you. The app will ask before it looks. You can change this in your browser or phone at any time.

Why we use it

• To run the app, which is what we need to do the job you have signed up for.
• To make the app better, which is a fair reason under EU law.
• To keep the app safe and to stop misuse.
• To send you news you have asked for. You can stop these at any time.
• To follow the law when we have to.

We do not sell your details to anyone.

Who else sees your details

• Lovable, the company that runs the app for us.
• Supabase, the company that keeps the database, sign-in and photo storage.
• Google, for sign-in and some optional services.
• Other hosting companies, who keep and handle data for us under strict written promises.
• Simple tools that show us how the app is used, which do not follow you around other websites.
• Help-desk tools, to answer questions and support tickets.
• The authorities, if the law says we must share.

All of these companies are either in the EU, or work under safeguards that the EU has approved.

How long we keep it

• Account details, while your account is open, and up to twelve months after you close it.
• Notes about how the app is used are made anonymous or deleted within twenty-six months.
• Help messages, up to three years in case you write again.
• Photos and spots you upload are deleted when you remove them or close your account.

We may need to keep some things for longer if the law asks us to, for example for tax records.

How we keep it safe

We use up-to-date safety steps, including secure connections, careful sign-in rules and regular checks. No system is ever perfectly safe, but we work hard to protect your details.

If a problem happens that puts your details at risk, we will tell you and the authorities within seventy- two hours, as EU law asks.

Children

SunSpotters is not meant for children under sixteen. We do not knowingly keep details about children under sixteen, and our terms do not let them use the app. If you think we hold details about a child under sixteen, please tell us and we will remove them.

Under EU law you have a number of rights over your details. Using these rights is free. We will reply within one calendar month.

• See your details. Ask for a copy of everything we hold about you.
• Put things right. Ask us to fix anything about you that is wrong or missing.
• Ask us to delete. Ask us to remove your details.
• Take your details with you. Get your details in a form you can move to another service.
• Say no. Ask us not to use your details for our own fair reasons.
• Ask us to pause. Limit what we do with your details while a query is being sorted out.
• Change your mind. Take back permission you have given, at any time.
• Raise a concern. Speak to the Dutch data protection body at autoriteitpersoonsgegevens.nl.

To use any of these rights, just write to privacy@sunspotters.net. We will never charge you for a simple request. We may ask you to prove who you are before we act.

Cookies are small notes that a website keeps on your device. We use them to keep the app working and to see how it is used. Under EU law we need your say-so before we use the ones that are not essential.

You can manage cookies in your browser settings at any time. Removing them will sign you out of any open session.

If you have any questions about these terms or about how we handle your details, or if you want to use your rights, please get in touch. We aim to reply within five working days for general questions, and within one calendar month for formal requests about your details.
